Terms of Service – Beaufood

These Terms of Service (“Terms”) govern your access to and use of kitchenustore.com (the “Site”), including any purchases of products made through the Site. The Site is operated by beau tony Japanese food LLC (“Company,” “we,” “us,” or “our”), with a registered office at 2717 W Olympic Blvd, Los Angeles, CA 90006. By using the Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Site.

All transactions are processed in Euros (EUR). We primarily serve customers in Europe but accept global orders. These Terms are a legally binding agreement between you and beau tony Japanese food LLC.

1. Eligibility and Account Registration

By using the Site, you represent that you are at least 18 years old or the age of majority in your country of residence. If you are under 18, you may only use the Site with the involvement of a parent or guardian.

You may browse the Site without creating an account. To place an order, you may check out as a guest or create an account. If you create an account, you agree to:

  • Provide accurate, current, and complete information.

  • Maintain the security of your password and accept responsibility for all activities under your account.

  • Notify us immediately of any unauthorized use of your account at service@kitchenustore.com.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

2. Products and Pricing

a. Product Descriptions
We strive to display accurate product information, including materials, dimensions, weight, country of origin, and care instructions for our Japanese kitchenware. However, we do not warrant that product descriptions, images, or other content are error-free. Slight variations in color, grain, or finish may occur due to natural materials (e.g., wood, ceramic glaze). If a product offered by us is not as described, your sole remedy is to return it in unused condition subject to our Return Policy.

b. Pricing
All prices are displayed and charged in Euros (EUR). Prices exclude shipping costs, which are calculated at checkout. We reserve the right to change prices at any time without prior notice. Price changes will not affect orders already accepted by us.

c. Typographical Errors
In the event of a manifest error (e.g., a knife listed at €5 instead of €50), we reserve the right to cancel the order and refund any amounts paid, even after you receive an order confirmation.

3. Orders and Acceptance

Placing an order on the Site constitutes an offer to purchase the products. After you place an order, you will receive an automated email acknowledging receipt. This email does not constitute acceptance of your order.

We reserve the right to accept or reject any order for any reason, including but not limited to: product unavailability, payment verification failure, suspected fraud, shipping restrictions (e.g., knives to certain countries), or pricing errors. If we reject or cancel an order after payment has been processed, we will issue a full refund to your original payment method.

An order is considered accepted only when we ship the products and send a shipping confirmation email. At that point, a binding contract is formed between you and beau tony Japanese food LLC.

4. Payments and Currency

We accept the following payment methods:

  • Credit cards (Visa, Mastercard, American Express, Discover)

  • PayPal

  • Apple Pay and Google Pay (if available on the Site)

All payments are processed in Euros (EUR). Your payment card issuer or PayPal may apply currency conversion fees if your card’s billing currency is not EUR. These fees are your responsibility.

We use third-party payment processors (Stripe, PayPal) to handle your payment information. We do not store full credit card numbers on our servers. By providing your payment details, you authorize us to charge the total order amount (including taxes and shipping) to your selected payment method.

5. Shipping and Delivery

Shipping terms are detailed in our Shipping Policy. Key points include:

  • Orders are processed within 1-3 business days.

  • Estimated delivery times vary by destination (3-14 business days).

  • Risk of loss and title for products pass to you upon delivery to the carrier.

  • We are not responsible for delays caused by customs, weather, or carrier strikes.

  • For fragile items (ceramics, porcelain, glass), we pack with extra protection, but you must inspect upon delivery and report damage within 48 hours.

6. Returns and Refunds

Returns are governed by our Return Policy. In summary:

  • Unused, unwashed products in original packaging may be returned within 14 days (EU customers) subject to a 15% restocking fee and with you paying return shipping.

  • Defective or incorrect items may be replaced or refunded with free return shipping.

  • Opened knives or hygiene-sensitive utensils cannot be returned for change of mind.

  • Ceramics must be returned in original protective packaging; insufficient packaging may result in denied refund.

Your statutory rights as a consumer are not affected.

7. Prohibited Uses

You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. Prohibited activities include:

  • Violating any applicable laws or regulations, including importing knives where prohibited.

  • Attempting to gain unauthorized access to our systems or other users‘ accounts.

  • Using robots, spiders, or other automated means to access the Site without our written permission.

  • Interfering with the proper working of the Site, including introducing viruses or malicious code.

  • Harassing, abusing, or threatening any person.

  • Collecting personal information of other users without their consent.

Violation of these provisions may result in immediate termination of your access and legal action.

8. Intellectual Property

All content on the Site, including text, graphics, logos, product images, recipes, blog posts, and software, is the property of beau tony Japanese food LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view, download, and print pages from the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content without our prior written consent.

“Beaufood” and our logos are trademarks of beau tony Japanese food LLC. Other product names and logos (e.g., brand names of Japanese knife manufacturers) may be trademarks of their respective owners.

9. User-Generated Content

If you post reviews, comments, photos, or other content (“User Content”) on the Site, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

You represent that you own or have permission to post the User Content and that it does not violate any third-party rights or applicable laws. We reserve the right to remove or edit any User Content for any reason, including content that is defamatory, obscene, or off-topic.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. BEAU TONY JAPANESE FOOD LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT PRODUCT DESCRIPTIONS, PRICES, OR OTHER CONTENT ARE ACCURATE, COMPLETE, RELIABLE, OR CURRENT.

For kitchen knives: We do not warrant that any particular knife will meet your specific cutting needs or preferences, as performance depends on technique and maintenance. For ceramics: Natural variations in glaze, color, and kiln effects are not considered defects.

Some jurisdictions (including certain EU member states) do not allow limitations on implied warranties, so some of the above limitations may not apply to you. For EU consumers, your statutory warranty rights remain unaffected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BEAU TONY JAPANESE FOOD LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE PRODUCTS.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

For EU consumers, these limitations apply only to the extent permitted by applicable law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless beau tony Japanese food LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your violation of these Terms.

  • Your violation of any law or third-party rights, including importing or possessing knives in violation of local laws.

  • Any User Content you post.

  • Your use of the Site or products in a manner not authorized by these Terms.

13. Governing Law and Dispute Resolution

a. For European Union Consumers
If you are a consumer residing in the European Union, these Terms and any dispute arising out of or related to them shall be governed by the laws of your country of residence. You may bring legal proceedings in the courts of your country of residence. We retain the right to bring proceedings against you in your country of residence.

b. For Non-EU Users (including US)
For all other users, these Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.

c. Online Dispute Resolution (ODR)
For EU consumers, the European Commission provides an Online Dispute Resolution platform available at https://ec.europa.eu/odr. We are not obligated to use alternative dispute resolution, but we will consider it in good faith.

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of government, labor strikes, supply chain disruptions, pandemics, carrier failures, or raw material shortages affecting Japanese kitchenware production.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of beau tony Japanese food LLC.

17. Entire Agreement

These Terms, together with our Shipping Policy, Return Policy, Privacy Policy, and any other legal notices published on the Site, constitute the entire agreement between you and beau tony Japanese food LLC regarding your use of the Site and purchase of products, superseding any prior agreements.
